ARTICLE 1 - ACCEPTANCE OF TERMS

These conditions apply throughout the posting period of the services offered by www.reneveyrat.com. The client acknowledges having read at the time of placing the order, the terms and conditions set out in the www.reneveyrat.com site. All orders implies acceptance of these terms and conditions without any reservations. These general conditions of sale govern the contractual relationship between RENÉ VEYRAT SA and its client, the two parties accepting them without reservation. These conditions shall prevail over all other conditions contained in any other document, unless prior express written consent.

ARTICLE 2 – PRODUCTS

Photographs, diagrams, drawings or videos illustrating the products do not enter the contractual field. If errors do not affect the substantial characteristics of the product, the responsibility of RENÉ VEYRAT or www.reneveyrat.com or www.reneveyrat.fr cannot be engaged.

ARTICLE 3 - ORDER / PAYMENT

Internet is a method of sales that we offer to our customers. The automatic registration systems are considered as proof of the nature of the content and the date and time of the order. Www.reneveyrat.com the website allows credit card payments online or by PayPal. For payment by credit card online, the buyer accesses a secure server SSL and registers safely references to his credit card. The secure payment solution implementation is www.Stripe.com . According to the specifications of encryption software, the information provided by the buyer can not be intercepted by a third party. The buyer accepts in advance and unconditionally that RENÉ VEYRAT SA or www.reneveyrat.com performs the secure transaction. The buyer authorizes in advance his bank to debit his account to view information or statements transmitted by RENÉ VEYRAT www.reneveyrat.com SA, even in the absence of bills signed by the hand of the cardholder. The account debit authorization is given for the total amount of product purchased, including freight and container if applicable. The order validated by the customer will be considered effective only when the payment centers concerned have given their consent. In case of refusal, the order will be canceled. RENÉ VEYRAT or www.reneveyrat.com SA reserves the right to cancel any order from a customer with whom there is a dispute over payment of a previous order. The information stated by the buyer, when taking control commit this: if error in the address of the recipient, the seller can not be held responsible for failure in which he could deliver the product.

In the event that a client would accept a quote from the RENÉ VEYRAT SA (particularly for large orders), he agrees to pay 50% of tax to the order and the remaining 50% one month prior to delivery of the commodity. No cancellation can not be considered.

ARTICLE 4 - RUPTURES OF STOCK

In case one or several items were found to be out of stock, RENÉ VEYRAT SA undertakes to inform the customer within a reasonable time. In this case, RENÉ VEYRAT SA will propose a date of availability for this product(s) without exceeding 15 days. In case the customer refuses this new availability date, RENÉ VEYRAT SA will offer equivalent or greater amount of product without requesting financial compensation to the customer.

ARTICLE 5 - DELIVERY

The delivery service is available only for deliveries to the Paris region and for orders reaching specific amounts.

In case of non seizure of the mobile phone number on which the recipient is contacted when placing the order, RENÉ VEYRAT SA would not be held responsible in case of delivery problems.

RENÉ VEYRAT SA is under no obligation to prevent the recipient of the delivery. However, to facilitate delivery, RENÉ VEYRAT SA may prevent the recipient of its passage.

When ordering, the customer must ensure enter all the necessary particulars so that the driver can access the place of delivery (door code, floor, door, special instructions). In case of inability to access the place of delivery, RENÉ VEYRAT SA would not be held responsible in case of delivery problems.

When ordering, the customer must ensure that the recipient is indeed present at the delivery. In the absence of the recipient, RENÉ VEYRAT SA would not be held responsible in case of non compliance with delivery date and therefore damage of the flowers.

In case of delivery problems, CUSTOMER HAS 4 HOURS AFTER DELIVERY to inform RENÉ VEYRAT SA by mail to the address contact@reneveyrat.fr (with supporting photographs of the product). After this time, the request of the customer will be declared inadmissible.

Delivery will be made by RENÉ VEYRAT or www.reneveyrat.com. Responsibility for RENÉ VEYRAT SA will not be attained due to external events, incidental or any force majeure.

Are considered as force majeure releasing the seller from its obligation to deliver: war, riot, fire, strikes, bad weather, accidents and the impossibility of being supplied. In the case of out of stock, RENÉ VEYRAT SA undertakes to communicate to each product and to inform the purchaser by email if an order has already been passed by the latter. In case of late delivery exceeding 15 days and not due to force majeure, the customer may terminate the contract by letter AR or accept a new delivery date, shall not require a price reduction. For reasons of availability, an order can be delivered several times to the customer. The customer pays only once shipping costs. If the customer wishes 2 places of delivery or 2 dates of delivery, it places 2 orders, with delivery change. Otherwise, RENÉ VEYRAT SA reserves the right to deliver the entire order at once to the date agreed with the customer. In case the order would not be compliant, the customer may terminate the contract by letter AR within 15 days. In the absence of such notification to our customer service and after this period, the customer will be deemed to have accepted the order and all the components that make up and is no longer entitled to take legal action on that basis to the RENÉ VEYRAT against SA.

ARTICLE 6 - DELIVERY TIME

Delivery time on Paris & Suburbs (Dept. 75, 92500, 92380, 92410, 92600, 93400, 92800, 92150, 92210, 92310, 92360, 92130, 92170, 92240, 92120, 94250, 94270, 77000, 94220, 94160, 94300, 93100, 93170, 93260, 93310, 93500, 93300, 93210, 93400, 92110, 92300, 92200, 92100)

Same-day delivery on the Paris region is achievable if the order is validated before 12PM.

Example:

  • Order on Monday before 12 PM ---> delivery day
  • Order on Tuesday before 12 PM ---> delivery day
  • Order on Wednesday before 12 PM ---> delivery day
  • Order on Thursday before 12 PM ---> delivery day
  • Order on Friday before 12 PM ---> delivery day
  • Order on Saturday before 12 PM ---> delivery day
  • No delivery on Sunday

ARTICLE 7 - WITHDRAWAL

According to the Consumption Code Articles L121-20 and L121-20-1, in the case of distance selling or Internet selling, the consumer has a period of seven days to exercise his right of withdrawal, without having to justify reasons nor to pay penalties, except for cost of return under section BUT L121-20-2 of the Consumption Code, the custom made goods which, because of their nature, can not be returned or are liable to deteriorate or expire rapidly (eg, flowers) are not covered by the right of withdrawal.

ARTICLE 8 - PRICE

For each article, the price does not include shipping. In the order confirmation, the total is the final price, including all taxes and VAT. This price includes the price of items, handling, packaging, storage of goods and shipping costs.

ARTICLE 9 - DISPUTES

This contract is subject to French law and limited to the Metropolitan France. The company RENÉ VEYRAT SA can not be held liable for damages of any kind, whether intangible or physical, which may result from the misuse of products sold or abnormal use.

ARTICLE 10 - WARRANTY

In case of manufacturing defect of the product sold, the buyer has the legal guarantee against hidden defects of Article 1641 of the French Civil Code.

ARTICLE 11 - COMPUTER AND FREEDOMS

According to "Law and Freedoms" No. 78-17 of January 6 1978 the processing of personal information about customers has been declared to the Commission Nationale Informatique et Libertés (CNIL) under number 1972446. The law (Article 34 of the Act of 6 January 1978) gives a right to access, modify, rectify and delete data by asking it to RENÉ VEYRAT SA by email at: contact@reneveyrat.fr. Personal data is protected under the Data Protection Act, and are not used by third parties. At any time, the customer can edit the contact information directly on www.reneveyrat.com. All this data can be modified by the client. This one is entitled to request its removal from the RENÉ VEYRAT customer file. This information helps to further facilitate customer use RENÉ VEYRAT SA website, by avoiding, for example to force multiple re-entered, and take full advantage of all the features that the site offers to the customer. The customer's address is useful to send the invoice and order on time. The customer's telephone number allows RENÉ VEYRAT to contact the customer to track and deliver the order. The client's email address allows RENÉ VEYRAT to confirm customer orders.

ARTICLE 12 - EVIDENCE

By derogations in 1341 and following of the Civil Code, computer information held by RENÉ VEYRAT or www.reneveyrat.com constitute proof of the contractual obligations of the parties. This type of evidence is both admissible for amounts below or above 750 euros. In case of failure of settlement, the dispute concerning the interpretation or execution of the contract will be competence of the Commercial Court of Paris.

ARTICLE 13 – MODIFICATIONS

The company RENÉ VEYRAT SA or www.reneveyrat.com or www.reneveyrat.fr reserves the right to adapt or modify at any time these Terms and Conditions will be immediately brought to the attention of the buyer an update online and dated (see top of page).

ARTICLE 14 – MÉDIATION

In accordance with Article L. 612-1 of the Consumer Code, the consumer, subject to Article L.612.2 of the Consumer Code, has the right to submit a request for amicable resolution by way of mediation, within a period of less than one year from its written complaint to the professional. René Veyrat has designated SAS Médiation Solution as mediation entity, number 31241/VA/2202. To contact the mediator, the consumer can make his request by post, email or by completing the online form entitled "Refer to the mediator" on the website www.sasmediationsolution-conso.fr.

Regardless of the means of referral used, the request must imperatively contain: The applicant's postal, telephone and electronic contact details. The name, address and registration number at Sas Médiation Solution of the professional concerned. A brief statement of the facts. The consumer will specify to the mediator what he expects from this mediation and why. Copy of the prior complaint. All documents allowing the instruction of the request (purchase order, invoice, proof of payment, etc.)
